TERMS & GENERAL CONDITIONS

All rentals are subject to the terms and conditions included in the rental agreement between the renter “VIVA motorent” (Motor Tours Rentals & Services, S.L.), and the hirers. The subject of the rental agreement is the temporary authorization to the hirers to properly use the motorcycles property of “VIVA motorent” (Motor Tours Rentals & Services, S.L.) for the reserved and confirmed rental periods

Rider requirements:
-Minimum 25 years of age
-Minimum 3 years of motorcycle driver’s license Spanish "A" or equivalent, or 1 year for Spanish "A2" class or equivalent
-Minimum 2 years of accredited riding experience on similar bikes
-Additional riders allowed only when conveniently named, included, and signed in the rental agreement

Valid Permits for riding in Europe:
-permits issued in countries of the European Union and the European Economic Area (Iceland, Liechtenstein and Norway)
-the national permits of other countries that are issued in accordance with Annex 9 of the Geneva Convention, or with Annex 6 of the Vienna Convention, or who differ from these models only in the adoption or removal of non-essential headings
-the national permits of other countries that are written in the language of the country to be visited or that are accompanied by an official translation of the same
-International Permits issued abroad in accordance with Annex 10 of the Geneva Convention, or in accordance with the model of Annex E of the Paris International Convention, in the case of nations adhering to this Convention that have not signed or lent adherence to Geneva
-those recognized in particular international agreements to which Spain is a party and under the conditions indicated therein

Reservations and payments:
-We recommend to reserve well in advance to secure your preferred dates
-Please use the “Reservation Form” from the website for booking
-All rental rates including VAT
-Upon confirmation, you will have to pay a deposit of 25% of the total rental cost through the linked payment gateway. A valid credit card (VISA, MasterCard, or AMEX) will be required
-The deposit will be taken as a credit towards your rental
-Rentals including discounts will be paid in full at confirmation
-At this time, the motorcycle/s will be booked for the requested dates
-Balance to be paid in full when collecting the bikes, as indicated on the confirmation form
-Published rates include 300km/day. The cost for extra mileage goes from 0,20 Eur to 0,45 Eur per extra km depending on the motorcycle model, VAT included

Pick up & Drop off:
-"VIVA motorent" will always try to provide customers with the confirmed motorcycle model. If due to force majeure this is not possible, customers will be informed with alternative option, offering them another model of the same group or higher (at no extra cost). If the change is not accepted by the client, the deposit will be reimbursed, the reservation being closed, and the client declining to claim "VIVA motorent" any other responsibility or penalty
-Motorcycles will be collected and returned at our bases according to the established schedule
-They can also be collected and returned at other previously agreed points such as Airports, Ports, Stations and Hotels with an extra cost

 

Rental:
-Our normal hours of operation are 9am to 8pm Monday to Sunday. Other hours and weekends under demand subject to confirmation
-Rental period is calculated on a 24-hour basis starting at the time of rental
-There is a damage excess deposit to be taken at the time of rental. Should you not have the credit available on your credit card or the operation not being accepted by the bank, we cannot provide the motorcycle
-Insurance coverage on the bike has a 1000 Euros to 2400 Euros deductible, depending on the motorcycle model. For some models there will be the option to reduce the damage excess with an extra cost when collecting the bike
-Our motorcycles are allowed to be ridden in all European countries with a few exceptions: Albania, Belarus, Bosnia Herzegovina, Bulgaria, Kosovo, Moldavia, Montenegro, Romania, Russia, Serbia and Ukraine
-It is also allowed to ride in Morocco, but only as a participant in some of the “VIVA motorent” Guided-Tours, third partner's tours or with a special authorization
-Hirers must always park in secured places and use the provided brake disk locks when leaving the bikes unattended for any length of time. We will not replace a stolen bike
-All the motorcycles are supplied and should be returned full tank. The fuel charge is priced at 2,00 Euros/liter (95 Octane), plus a 15€ fee for refueling
-The motorcycles must be returned on the agreed date and time. If you wish to extend the rental period, it will be permitted subject to availability, and should be notified to the “VIVA motorent” staff at least 48 hours in advance
-Late returns with no previous advice will incur a penalty of 60 Euros for every complete hour exceeding the designated return time, or its proportional cost per minutes
-Tickets and fines are the responsibility of the hirer, and we’ll be obliged to provide your personal details to the Authorities. An additional 30 Euros administration fee per fine will be charged on your credit card

Prohibited Uses:
Hired motorcycles may not be used:
-by any person who is not an authorized driver in the rental agreement
-by anyone with a suspended driver’s license or incapable of driving
-by any person who is under the influence of alcohol, drugs (either stimulant or depressant) and/or other substances than may negatively affect driving conditions
-for off-road driving
-for broadcasting, filming and/or any other commercial purposes
-for the practice of any motorcycle competition events
-for any illegal purposes or in connections with any illegal activity
Very important: failure to comply with these rules, incidents produced by not respecting the traffic laws, abandoning the scene of an accident, and/or exceeding the agreed rental period without any previous notice, will result in the security deposit being forfeited. And any damages will be the responsibility of the renter despite the cost as the insurance purchased does not cover the situations previously stated


Cancellation and changes:
-Confirmed reservation cancellations fees will be charged as detailed below:
-more than 30 days before the start of the rental…..15% of the total amount of the rental
-30-15 days before the start of the rental.………….….25% of the total amount of the rental
-14-7 days before the start of the rental.……………..…50% of the total amount of the rental
-6-3 days before the start of the rental.……………....…75% of the total amount of the rental
-within 72 hours before the start of the rental........100% of the total amount of the rental
-In all cases, your deposit can be used towards a future rental within the following 12 months
-Changes permitted until 24 hours before the start of the rental, with a 30 Euros admin fee surcharge
-In case of cancellations due to "force majeur" outside the control of “VIVA motorent” (Motor Tours Rentals & Services, S.L.) and the customers, such as prolonged strikes, regional health alerts, war and natural disasters amomg others, “VIVA motorent” (Motor Tours Rentals & Services, S.L.) reserves the right to hold all the money payed by the clients at the moment of cancellation. This amount can be used towards a future rental within the following 24 months from the cancelled rental starting date
-If the rental had already started and had to be interrupted, “VIVA motorent” (Motor Tours Rentals & Services, S.L.) reserves the right to hold all the money payed and use the proportional part of the amount for the non-used days towards a future rental within the following 24 months from the cancelled rental starting date


Medical insurance:
-Medical insurance is not included in the rental and is at your own responsibility. We do highly recommend a policy including repatriation.


Personal data:
In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April / General Data Protection Regulation / “VIVA motorent” (Motor Tours Rentals & Services, S.L.), domiciled at Carrer de Robrenyo 68, local 2, 08014 Barcelona, informs you that all the data per you provided for bookings, payments, rental agreements and invoicing will form part of an inventory of the processing of personal data, the responsibility of this entity, with the aim of sending you commercial and advertising information about our products and services by any means, including electronic means.
To exercise your rights of access, rectification, opposition, suppression, limitation, and portability recognized by current legislation, please contact us at Carrer de Robrenyo 68, local 2, 08014 Barcelona, attaching a copy of your National Identity Card or equivalent identification document.
